GENERAL TERMS & CONDITIONS

These terms and conditions affect your legal rights. It is important that you read this agreement carefully before making a purchase. By signing this agreement or by selecting “I agree to the Terms and Conditions” you acknowledge that you have read, understood and agreed to be bound by the terms and conditions in this agreement. If you are making a purchase on behalf of another person, you agree that you are their agent so that they will be bound by this agreement.

Clip 'N Climb New Zealand Limited (NZBN: 9429042295044) (Trading as “Clip 'N Climb North Shore”) as the supplier of recreational services, sells all tickets and supplies all recreational services and facilities to the customer (“you”), including but not limited to: climbing, lessons, entertainment, food & drinks, function rooms and use of the Clip 'N Climb climbing arena within the Clip 'N Climb North Shore venue. All use of the facilities at Clip 'N Climb North Shore is undertaken according to the Terms and Conditions in this agreement, the safety rules and restriction guidelines on the Clip 'N Climb North Shore website and the instructions given during safety briefings. By purchasing a climbing session and/or participation in a session at Clip 'N Climb North Shore, you are deemed to have accepted the Terms and Conditions in this agreement and signed the online Waiver Statement with Clip 'N Climb North Shore.

Participation Statement:

By participating you agree to the Terms & Conditions and Safety Rules & Restriction Guidelines below. You should be in good health to participate in physical activity and participate in accordance with these rules. It is the parents/guardians responsibility to ensure that their children adhere to these safety rules. Climbing is not recommended for guests that have neck or back problems, heart problems or have had recent surgery. If you are pregnant, you are not permitted to climb. If you encounter any problems or have any pre-existing medical conditions please discuss these with a staff member of Clip 'N Climb North Shore.

Disclaimer:

By agreeing to these Terms and Conditions, you acknowledge that climbing can be a dangerous pastime with inherent risks and hazards and as a consequence personal injury and sometimes death can occur and you assume and accept all such risks. Clip 'N Climb North Shore has taken every possible step to ensure that you have a completely safe and fun experience through the use of the automatic belay devices, high quality harnesses and the employment of a qualified and experienced team. However, we cannot accept any responsibility for injuries sustained due to negligence on the part of the participants. For you to enter the arena, we will require that you confirm that you accept responsibility for you and your party during your time in the Clip 'N Climb North Shore climbing arena.

Release:

Subject to the provisions in this agreement, you release, discharge and forever hold harmless Clip 'N Climb North Shore, its employees, directors and agents from all liability, obligation and responsibility of any nature for death or for any losses, damages or injuries relating to or arising directly or indirectly from your engagement in the recreational activity and from your participation in any related or incidental activities.

This Release shall be binding on your Estate and may be pleaded by Clip 'N Climb North Shore as a complete bar in relation to any action, suit, claim or demand of any nature that you may bring against Clip 'N Climb North Shore or which may be brought on your behalf. This Release shall extend and shall apply to all conduct of Clip 'N Climb North Shore including, without limitation, the circumstances where the facilities pursuant to which the recreational activity takes place were not supplied with due care and skill or not fit for purpose or because of negligence, breach of contract, statute or statutory duty by Clip 'N Climb North Shore. In no event shall Clip 'N Climb North Shore be liable for loss of profit or consequential damages, whether based on breaches of contract, warranty or otherwise.

General Guidelines:

Entry price includes the hire of the full safety equipment, a 10 minute introduction and safety briefing then an 1 hour climbing session.
Please arrive 30 minutes prior to your booked session for processing, harnessing up and your 10 minute safety briefing.
Participants must be a minimum of 4 years of age with a minimum weight of 15kg and a minimum height of 100 cm to use the climbing facilities in Clip 'N Climb North Shore.
Parents/Guardians remain responsible for their child’s welfare at all times
Please note: children aged 13 and under must be accompanied by a responsible adult who is required to sign the disclaimer form and be present during the climbing session. Unaccompanied children will not be allowed to climb and will lose their booked session. Exception for After School Programme attendees.
If one parent or guardian is bringing multiple kids, some of which are not his/her own, that adult is responsible for that group.
All climbers are required to have an active Clip 'N Climb North Shore online waiver. Clip 'N Climb North Shore allows children aged 14 and 15 be independently present at Clip 'N Climb North Shore premises by themselves but required a responsible adult to sign the online General Terms and Conditions and Waiver Statements on the children's behalf before the climbing session.
All bookings are subject to our Booking/Cancellation/Refund Policy stated in Terms and Conditions.
Participants must follow the below Safety Rules and Restriction Guidelines:

Climbers MUST

Climbers must have a colour coded session wrist band before entering the climbing arena.
Climbers must wear a Clip 'N Climb harness at all times when inside the climbing arena.
Climbers must attend a Safety Briefing before climbing.
Climbers must always be clipped to the auto belay before climbing.
Climbers aged 13 and under must have their belay line connection checked by an adult each time before they climb.
Climbers must follow Staff instructions, Safety Rules and Restrictions at all times.
Climbers must tie long hair back and no jewellery is to be worn. Eye wear to be secured.
Climbers must wear closed toe shoes and comfortable clothing.

Climbers MUST NOT

Climbers must not eat, chew gum or drink in the climbing arena.
Climbers must not run, jump or push each other in the climbing arena.
Climbers must not hold onto or pull down on the safety rope whilst climbing.
Climbers must not bounce out from the wall during descent.
Climbers must ensure there is only one climber per wall.
Climbers must not be pregnant, impaired by a medical condition or are wearing a cast.
Climbers must not wear skirts or dresses, jandals, sandals, high heels or climb barefooted.
Climbers must not consume alcohol before or during their climbing session.

Fees, Charges and Tickets/PASSES:

All transactions are in New Zealand Dollars (GST inclusive). Fees and charges are shown on the Clip 'N Climb North Shore website and at the venue and are subject to change without notice. Booking online in advance is recommended to ensure space is available. You are required to pay the session fee in full prior to being admitted into that session. Tickets/passes issued remain the property of Clip 'N Climb North Shore and are void if tampered with. 10 Session Passes, Family Passes and Gift Certificates are non-refundable and void after the 12 month expiry date. All Clip 'N Climb North Shore tickets/passes are valid only for the date and time shown and may not, without the prior written consent of Clip 'N Climb North Shore, be resold or offered for resale at a premium or used for advertising, promotion or other commercial purposes either by you as the original purchaser or any subsequent bearer.

You acknowledge that despite Clip 'N Climb North Shore’s reasonable precautions, Clip 'N Climb North Shore products and services may be listed at an incorrect price, with incorrect information, or which are unavailable due to an error or oversight. In these circumstances, Clip 'N Climb North Shore reserves the right to cancel the transaction, notwithstanding that your booking has been confirmed and your credit card has been charged.

Booking / Cancellation / Refund Policy:

General Admission Climbing Bookings: At Clip 'N Climb North Shore, all casual climbing session bookings are NON-REFUNDABLE but can be rescheduled once less a $5 transaction fee per transaction. Rescheduling is subject to availability. To reschedule, you need to telephone Clip 'N Climb North Shore on 09-447-1428 giving at least the below minimum period of prior notice, and make the appropriate arrangements with one of our staff with the new date and time which will require confirmation by an email or text from Clip 'N Climb North Shore. Please Note: Booking Fee is 100% NON-REFUNDABLE.

Bookings for less than 10 climbers - Should you need to reschedule your session for whatever reason, we will require a minimum of 48 hour notice prior to your booked session. Unfortunately, we are unable to offer any rescheduling if less than a 48 hour notice is given and then the booking/cancellation/refund policy applies.
Bookings for more than 10 climbers - Should you need to reschedule your session for whatever reason, we will require a minimum of 7 day notice prior to your booked session. Unfortunately, we are unable to offer any rescheduling if less than a 7 day notice is given and then the booking/cancellation/refund policy applies.
After School Programme - Should you need to reschedule your 9 week After School Programme for whatever reason, we will require a minimum of 7 day notice prior to the starting date of your booked After School Programme. Unfortunately, we are unable to offer any re-scheduling if less than a 7 day notice is given and then the booking/cancellation/ refund policy applies.

Corporate Events / Exclusive Hire / Group / Party / School Bookings:

At Clip 'N Climb North Shore, you are eligible to make amendments or cancellation for any Corporate, Exclusive, Group, Party or School bookings giving at least the below minimum period of prior notice, and make the appropriate arrangements with one of our staff followed by a confirmation email or text from Clip 'N Climb North Shore. To make any changes, please telephone Clip 'N Climb North Shore on 09-447-1428. Please Note: Booking Fee is 100% NON-REFUNDABLE.

Catering Option Amendment - Should you need to make any amendments to the catering options for your booking for whatever reason, we will require a minimum of 7 day notice prior to your booking. Unfortunately, we are unable to make any catering changes if less than a 7 day notice is given.
Rescheduling your Booking - Should you need to reschedule your booking for whatever reason, we will need a minimum of 7 day notice. You are entitled to reschedule once less a $5 transaction fee per booking. Unfortunately, we are unable to offer any rescheduling if less than a 7 day notice is given.
Partial Cancellation of your Booking - Should you need to cancel part of your booking for whatever reason, we will need a minimum of 7 day notice for you to qualify for a refund less a $5 booking fee per transaction. Unfortunately, we are unable to offer any refunds if less than a 7 day notice is given.
Cancellation of your Booking - Should you need to cancel your booking for whatever reason, we will need a minimum of 7 day notice for you to qualify for a refund less a $50 cancellation fee per booking. Unfortunately, we are unable to offer any refunds if less than a 7 day notice is given.
Please note there will be NO REFUND for no-shows on the day.

Age Restrictions:

Children must be at least 4 years of age with a minimum weight of 15kg and a minimum height of 100cm to use the climbing facilities in Clip 'N Climb North Shore.

Children aged 13 and under must be supervised by a responsible adult. The adult responsible for such children agrees to be bound by these General Terms and Conditions on their behalf and will directly supervise the child at all times.

Health and Emergency Treatment:

You acknowledge and are aware that the physical and mental exertion required to engage in the recreational activity and/or to participate in the activity can activate or aggravate a pre-existing physical condition, so you are required to be in good health and free from any adverse medical conditions. You are not permitted to participate in climbing if you are pregnant, impaired by a medical condition or are wearing a cast. You should seek medical advice if you are in doubt about your health. You agree to pay the cost of and authorise Clip 'N Climb North Shore to take all steps it considers reasonably necessary to protect your welfare in the event of personal injury, including the administration of any emergency medical treatment and ambulance transportation.

Health and Safety Regulation:

No outside food or drinks is permitted inside Clip 'N Climb North Shore.

Actions of Others: You acknowledge that that there are inherent risks that may arise from the actions of other participants and/or spectators that are not condoned by Clip 'N Climb North Shore, but which may nevertheless still occur, which include pedestrian traffic, irresponsible, unreasonable, excessive, reckless, careless, unkind, wanton and generally objectionable behaviour whether intentional or unintentional.

Right to Refuse Entry:

Clip 'N Climb North Shore holds the right to refuse entry or cancel your access to use the facility if you:

reasonably appear to be under the influence or in the possession of alcohol or illicit substances;
fail to comply with Safety Rules and Restriction Guidelines and/or fail to follow the instructions of Clip 'N Climb North Shore staff;
behave in an offensive, reckless, careless or threatening manner to other customers or staff; and
are reasonably deemed to be a danger to yourself, other customers or Clip 'N Climb North Shore staff.

Consent for Video, Images and Email:

You acknowledge and give consent that, upon entering the Clip 'N Climb North Shore premises, you and children for whom you are responsible for may be photographed and/or videoed for security, safety and promotional purposes. By providing your email to Clip 'N Climb North Shore you consent to receiving promotional and advertising material from time to time.
